Terms and Conditions

Welcome to Mountain Paradise India, your trusted partner for unforgettable treks and expeditions in the breathtaking landscapes of Uttarakhand. By booking with us, you agree to abide by the following Terms and Conditions (T&C). Please read them carefully, as they govern your participation in our treks and form a legally binding agreement between you and Mountain Paradise India. We reserve the right to update these T&C, with the latest version available on our website.

1. Booking and Payment

1.1 Booking Process:

  • To secure a spot, participants must either pay the full deposit or pre-book with a non-refundable deposit of INR 1,000.
  • For pre-bookings, the remaining balance must be paid in full 14 days prior to the trek commencement date.
  • Bookings are confirmed only upon receipt of the required payment and submission of all necessary documents (see Section 5).

1.2 Payment Methods:

  • We accept payments via Razorpay, UPI, and bank transfer.
  • All payments must be made in Indian Rupees (INR) unless otherwise specified.
  • Any transaction fees (e.g., bank charges) are the responsibility of the participant.

1.3 Group Bookings:

  • For group bookings, one point of contact must coordinate payments and documentation unless otherwise agreed.

2. Cancellation and Refund Policy

2.1 Participant Cancellations:

  • Cancellations must be submitted in writing via email to mountainparadiseindia@gmail.com
  • Full Deposit Bookings:
    • If cancelled 21 days or more before the trek commences: 100% refund of the booking amount.
    • If cancelled within 14 days before the trek commences: 50% refund of the booking amount.
    • If cancelled less than 14 days before the trek commences: No refund.
  • Pre-Booking Deposit (INR 1,000): Non-refundable under all circumstances.

2.2 Cancellations by Mountain Paradise India:

  • In the event of cancellation by Mountain Paradise India due to uncontrollable circumstances (e.g., natural calamities, social unrest, government restrictions, or insufficient group size), participants will receive a trek voucher equivalent to the full booking amount.
  • Trek vouchers are valid for 12 months from the date of issue and can be redeemed for the same or any other trek offered by Mountain Paradise India.
  • No cash refunds will be issued for cancellations initiated by Mountain Paradise India unless otherwise specified.

2.3 Non-Refundable Items:

  • Costs related to permits, third-party bookings, or administrative fees are non-refundable unless explicitly stated.

3. Trek Services and Inclusions

3.1 Services Provided:

  • Our trek packages typically include experienced guides, porters (if specified), meals, accommodation (tents or lodges as per itinerary), permits, and safety equipment, as outlined in the trek-specific details.
  • Services not explicitly listed (e.g., personal gear, travel to the starting point) are the participant’s responsibility.

3.2 Subcontractors:

  • Mountain Paradise India may engage third-party providers for services like transport or accommodation. We ensure all subcontractors meet our safety and quality standards.

3.3 Gear Rental (if applicable):

  • If Mountain Paradise India provides rental gear, participants are responsible for its proper use and return. Any damage or loss will incur additional charges, as communicated at the time of rental.

4. Itinerary Changes

4.1 Modifications:

  • Mountain Paradise India reserves the right to modify trek itineraries due to safety concerns, weather conditions, government regulations, or other unforeseen circumstances.
  • Participants will be informed promptly of significant changes, and efforts will be made to maintain the trek’s overall experience.

4.2 Minimum Group Size:

  • Treks may be cancelled or merged with other groups if the minimum group size (as specified in the trek details) is not met. In such cases, participants will receive a trek voucher or alternative options.

5. Participant Responsibilities and Requirements

5.1 Eligibility:

  • Participants must be physically fit and mentally in good health to undertake treks in the Himalayas, as these activities involve strenuous conditions at high altitudes.
  • Mountain Paradise India reserves the right to deny participation if a trekker’s health or fitness appears inadequate, prioritizing group safety.

5.2 Documentation:

  • Participants must submit the following mandatory documents at least 14 days prior to the trek:
    • Valid government-issued ID (e.g., Aadhaar, passport).
    • Medical certificate from a registered doctor confirming fitness for high-altitude trekking.
    • Signed disclaimer form (provided by Mountain Paradise India).
    • Proof of travel/medical insurance covering high-altitude trekking, accidents, and evacuation.
  • Failure to provide these documents may result in cancellation without refund.

5.3 Compliance:

  • Participants must adhere to:
    • Local laws and regulations (e.g., forest department rules, restricted area permits).
    • Safety guidelines provided by trek leaders and staff.
    • Environmental practices (e.g., no littering, minimizing ecological impact).

5.4 Personal Liability:

  • Participants are solely responsible for any accidents, injuries, or loss of personal belongings during the trek.
  • Mountain Paradise India strongly recommends carrying personal items securely and obtaining insurance for valuables.

6. Safety and Emergency Protocols

6.1 Safety Commitment:

  • Mountain Paradise India follows a no-compromise policy on participant safety, employing experienced and qualified trek leaders trained in high-altitude safety and first aid.

6.2 Emergency Procedures:

  • Our field team is equipped to handle emergencies, including evacuation if necessary. However, participants are responsible for all costs associated with emergency evacuations (e.g., helicopter, ambulance, medical treatment).
  • Mountain Paradise India, its staff, or subcontractors will not be held liable for accidents, injuries, or losses during emergencies.

6.3 Health Disclosures:

  • Participants must disclose any pre-existing medical conditions (e.g., heart issues, asthma) during booking. Non-disclosure may lead to exclusion from the trek without refund.

7. Liability and Risk

7.1 Assumption of Risk:

  • Trekking in the Himalayas involves inherent risks, including altitude sickness, extreme weather, and rugged terrain. By booking, participants acknowledge and accept these risks.

7.2 Limitation of Liability:

  • Mountain Paradise India, its staff, guides, and subcontractors will not be liable for any accidents, injuries, loss of personal belongings, or damages incurred during the trek, except as required by Indian law.
  • Participants must sign a liability waiver prior to the trek, releasing Mountain Paradise India from responsibility for unforeseen incidents.

7.3 Force Majeure:

  • Mountain Paradise India is not liable for disruptions caused by events beyond our control, including but not limited to natural disasters, government restrictions, political unrest, or pandemics. In such cases, trek vouchers will be issued (see Section 2.2).

8. Environmental and Cultural Responsibility

8.1 Eco-Friendly Practices:

  • Mountain Paradise India is committed to preserving Uttarakhand’s pristine environment. Participants must:
    • Avoid single-use plastics and littering.
    • Use designated waste disposal methods.
    • Follow “Leave No Trace” principles.

8.2 Respect for Local Communities:

  • Participants must respect the culture, traditions, and privacy of local communities, including refraining from unauthorized photography or intrusive behavior.

8.3 Sustainability Pledge:

  • By joining our treks, participants agree to support our mission of sustainable tourism and minimize their environmental footprint.

9. Complaints and Dispute Resolution

9.1 Reporting Issues:

  • During the trek, participants should report concerns immediately to the trek leader for prompt resolution.
  • Post-trek complaints must be submitted in writing within 7 days of trek completion via email to mountainparadiseindia@gmail.com.

9.2 Resolution Process:

  • Mountain Paradise India will acknowledge complaints within 48 hours and aim to resolve them within 14 days.
  • We encourage amicable solutions, prioritizing customer satisfaction.

9.3 Governing Law:

  • These T&C are governed by the laws of India, with exclusive jurisdiction in the courts of Dehradun, Uttarakhand.

10. Data Privacy

10.1 Collection and Use:

  • Mountain Paradise India collects personal information (e.g., name, contact details, medical data) to facilitate bookings, ensure safety, and comply with regulations.
  • Data is used solely for trek-related purposes and not shared with third parties, except as required by law or for service provision (e.g., permits).

10.2 Protection:

  • We comply with India’s Digital Personal Data Protection Act, 2023, safeguarding your information with secure systems.
  • Participants may request access to or deletion of their data by contacting mountainparadiseindia@gmail.com.

11. Special Conditions

11.1 Minors:

  • Participants under 18 years must provide parental consent and be accompanied by a guardian unless otherwise agreed.

11.2 Customized Treks:

  • For private or customized treks, additional terms may apply, as communicated during booking.

11.3 Promotions:

  • Offers, discounts, or trek vouchers are subject to specific terms provided at the time of promotion.

12. Intellectual Property

  • All content on Mountain Paradise India’s website, including itineraries, logos, and photos, is the property of Mountain Paradise India and protected by Indian copyright laws.
  • Participants may not use our content for commercial purposes without written permission.
